    New York Unemployment Appeal
    My question involves unemployment benefits for the state of: New York

    When writing my statement why I disagree with the ALJ decision, am able to expand on things in the transcript, or just state which lines I feel weren't considered and need to be looked at? Issue is misconduct.

    Example: if transcript says "office area was locked at 5PM", can I add in my statement "that wasn't always the case as the only working female bathroom was in the office area", or is that considered new and not allowed?

    Any help would be appreciated, I have 15 days to write my statement.

    Generally speaking, an appeal is based on record evidence, which means if you chose not to introduce evidence at the trial level you can't introduce it on appeal. You can check with the Department of Labor to see if they publish rules for appeal - I don't see any on their website.
