Relocation Procedure To Different County Within Pennsylvania
My question involves a child custody case from the State of: Pennsylvania
Hi, I currently live in Delaware county. My ex would not accept any offers for me to stay in the marital home with the kids, therefore I was forced to sell home. I'm currently unemployed because my ex keeps dragging me to court. We finally received an agreement of sale on the home, therefore, I have to move out soon.
I currently have primary physical custody and I planned on relocating children from Delaware county to Chester county (about 20 miles from father). I wasn't able to find an affordable apartment in the same town as we had the marital home, therefore I chose Chester county, which has great school districts, better than the existing one I currently live in. I also chose to stay closer to their father instead of my family in fear he'll take me to court and get custody for the move. What do I have to file in order to relocate to a different county? Ex said he had no problems with the move, so do I still have to ask the courts for permission to move? What if he changes his mind and won't allow me to move? Please shed some light on this stressful topic.

Do you have a final custody order in place, or is the order you reference a temporary order pending the outcome of your divorce? What does your existing order say about moving, and when court permission is required to move?

Divorce is still not final. Final custody order has no mention of restrictions of relocation, nothing stopping me from moving.

You are telling us that you have no final order of divorce, but you do have a final (not temporary) order of custody? That would be unusual, so please confirm for a fact that's what you are saying.

Divorce is not final. We are in process of finalizing property settlement agreement(equitable distribution) to finalize divorce. Current custody order issued April 2008 was supposed to be the final custody order. We sat in front of a master and mutually agreed that whatever he chose in the April custody order would be considered final. We both had the right to appeal the April custody order, but neither of us did. Long story short, we've had multiple temp custody orders and asked for a final one. Well, the master gave us a final one, which has no mention of relocation of any sort.

If you both want this move to occur, have your lawyers draft up a stipulated order approving the move and ask the court to enter it.

I don't have a lawyer because I'm unable to afford it anymore and because I'm unemployed. I can't get any legal aid because I have assets. I don't want to touch my retirement fund just to hire an attorney. I've gone thru 2 attorneys already, and they haven't helped me at all and now I'm almost $30,000 in debt, which could have been my children's money.
I was hoping I could get some advise as to where to start with the relocation paperwork without involving a lawyer....

My ex still has a lawyer because he can afford one. I don't have one because I'm unemployed and exhausted all my financial resources....I'm trying to do this on my own to reduce costs.
