    Domestic Violence In Arizona
    My question involves criminal law for the state of: AZ

    My wife and I were in an altercation in our home. Police were called by my wife and subsquently we were both arrested. My charges DV Disorderly Conduct and DV Cimminal Damages. My wife's charges DV Disorderly Conduct and DV Assault. All charges are brought by the state and not us. My wife and I have 33 year old clean records up until now and are very involved and productive members of our society. That night was a product of a few bad decisions and a little too much alcohol.

    Ultimately I would like these charge dropped, little to no chance of this. I have been looking into request the D.C charges for both of us to be dropped and requesting deferred sentencing on the Assault and Ciriminal Damages (I broke a door in MY house). In return we would go to court ordered marriage counsilling and anger management classes. I would make these request through the public prosecuter and the judge. Does this sound like the way to go? Any other advice?

    All charges in ANY type of criminal case are brought by the state, never by the victim. The odds of getting the charges dropped altogether, for both of you, are slim. But, you can each certainly work with your defense attorneys to see if the court will impose counseling, anger management, etc. as an alternative to incarceration under a plea agreement with the court. You might throw in some AA as well, if alcohol is a factor - DV and alcohol often go hand in hand - not because one CAUSES the other, but more often because both violence and drinking are unhealthy coping mechanisms - ways of dealing with or avoiding greater issues that need to be addressed (communication skills, marriage issues, etc.). Both of you would likely benefit from any or all of these, and might help you build a path to a healthier, safer, and more enjoyeable marriage for both of you.

I fell, sustained a concussion and told the cops that he hit me. He has NEVER touched me and I want his charges dropped and charges to be brought on me for falsifying a police report. He is the victim in this- not I. I have now enrolled in alcohol counseling with hopes that will help him get his charges dropped. Thoughts? Ideas? suggestions? thanks!
