    Changing My Son's Last Name
    MY SON HAS MY LAST NAME. AND I JUST MARRIED AND WE WANT TO CHANGE HIS LAST NAME. HIS FATHER IS NO LONGER ALIVE. MY HUSBAND IS THE ONLY FATHER HE KNOWS. WHAT DO I DO? IS IT LEGAL TO JUST CHANGE HIS LAST NAME? HIS BIOLOGICAL FATHER DIDN'T EVEN SIGN THE BIRTH CERTIFICATE.

    I WANT TO KNOW ALL MY OPTIONS. IF I DON'T GO THROUGH THE ADOPTION PROCESS WILL HE GET CUSTODY OF HIM IF I PASS AWAY? IN THE EYES OF THE LAW WILL HE BE CONSIDER HIS FATHER? OR WILL HE HAVE TO GO THROUGH A WHOLE LEGAL PROCESS? AND I ALSO WANT TO KNOW ABOUT A SIMPLE LAST NAME CHANGE.

    Not automatically. He would have to try to get custody or a guardianship through the courts, consistent with state law.

    Adoption makes him the child's father in the eyes of the law.

    There are probably standard name change application forms you can get at the court. As the child's father is deceased, he can't object, and you should be able to complete the process yourself.
