Pre-Prosecution And My Records
My question involves a background check in the State of: New Mexico
Back in 99 I got arrested for breaking and entering and theft. I went threw pre-prosicution and I was told that once I completed it, it would be taken off my record. I've not been arrested for anything since and have had jobs that you need other background checks like working for Health care places without then telling me anything.
Well i just got a job at a place you work with Disabled people and it's been about 6 months and they just got a letter saying I have a record on me.
When I was told when I went threw this pre-prosecution process it would be taken off my record, at least that's what I remember hearing. So why would this come up. I do know that they have my arrest record but since I went threw the process the case was suppost to be dropped wasn't it?
Also I was wondering since it's been awhile now if I'm somehow able to get it sealed or where I can go to start that process.

If you were told that pre-prosecution would result in your having no conviction on your record, but your record shows an arrest and possibly the initial charge, that would not be particularly surprising. Is that what has happened?
