Overnight Visitation Denied
My question involves a child custody case from the State of: CT
My ex and I have flexible visitation that is also in the Divorce papers. She has primary custody of our 9 y.o. son.
I have recently moved to NY State and am about an hour away from them. Before the move I was approximately 45minutes. We used to meet halfway for the drop off and pickup of our son. More often than not I would drive to her home to do both.
I lived alone for the duration - year and a half - and everything was fine; however, money has become an issue and I have found a nice place to move into with my girlfriend.
Problem - My ex will not let me see my son for overnights based on the case that I live with another person and am not married. If I come to CT for the day that is okay. Yet each time we speak she verbally yells, curses, and demeans me over the phone in front of our son. I do not retaliate or say a word, I just hang up, less energy and not worth the battle.
I know that our son is allowed out of state if asked, but even if my girlfriend and I lived in CT I would not be granted overnight visitation by my ex.
Who is right here? She or me?

Go back to court and get judge to issue an order on this then. that is your solution

Thanks. I was hoping to have an idea what I was dealing with before I went back to court. Money has been a major issue and I am not looking to spend more money by going to court. I need to save. I just don't know if cohabitating with somebody would jeopardize my visitation according to the court. The worst part is that my ex doesn't even want our son to meet my girlfriend. I have never introduced people to our son who I thought would not be a part of my life. Ugg.

This is why "flexible" visitation plans don't work out very well.
Unless the rules are stated, one of the parties ends up with their panties in a bunch.
Go back to court... but, be prepared. The judge may agree with your ex.
