Roommate Move
My question involves landlord-tenant law in the State of: Virginia
Hello
I recently moved out of my apartment and my roommate stayed. I turned my keys into the rental office, we tried to do a roommate release, however my roommate was not eligible to move into a smaller apartment. The agreement was that she would pay for all of May rent and move out on the 10th of May. She finally moved out this past weekend May 31st, and the May rent was never paid. I received a letter stating that we were getting evicted and I have to go to court on the 11th of June. The apartment told me that the security deposit would go for the May rent. My question is, Is there anything that I can do to get me out of having the eviction on my record? The apartment complex knew that I was not living there as of April 26th.

Your liability to your landlord is governed by your lease. If you didn't live up to your obligations under your lease, your landlord can pursue you for unpaid rent. It doesn't matter if you live in the apartment or not - if you're on the lease, you owe the rent. You suggest that you were not released by the landlord, so you remained bound by the lease.
You can talk to your landlord - my guess is that if you pay the money you owe, they'll drop the suit.

So is my roommate not going to be held liabil to the lease? If she decides not to pay then I have to pay the full amount?

If you're both on the lease, you're jointly and severally liable. The landlord is entitled to be paid by either of you or both of you. The rest, you need to work out with your roommate.
