My fiance is ilegally her but was never inspected or had a visa... We would like to get married now, but there is the big question is it better here or in his country he is from Guatemala. is there any advice you can help me with??

If he returns home, he may well be subject to a ten year exclusion based upon his illegal presence. But marrying him won't of itself give him status. Talk to an immigration lawyer.
