Changing Son's Last Name, No One Can Find The Father
My question involves name change laws in the State of: Florida and Indiana
I would like to change my son's last name to mine. The father did sign the birth certificate but has been none existent in his life for the past 3 years. He was born in Florida where the father is but we have lived in Indiana for the past 3 years which is where I am from. I left Florida due to losing custody of our son for 6 months for rib fractures that the court blamed on the father and he finally admitted to it. To this day he never finished his parenting classes and we have absolutely no contact with him due to some mental issues. The court granted me full custody of my son and the right to leave the state. The father is well aware of where his son is. There is no child support (even though I have filled out the appropriate forms for my county to send to Florida) or visits from him. He may make a phone call once every 6-8 months. I have heard that they have to notify the father which is fine but they cant even find him for child support. I would like to know the appropriate steps to take and what happens if they cant contact him.

Most state's have laws regarding notice by publication. Get a consult with a local attorney to find out what steps you must take for service by publication.
