Public Intoxication And Disorderly Conduct In Georgia

My question involves criminal law for the state of: ga

I drove up to the convenience store in the morning and wound up dozing off in the car again once I parked in front of the store, the cops broke my window and it made me jump awake, I got out of the car like what in the heck are you doing I was charged with disorderly conduct and public intox, I do recall I swore when I was waking up, the ticket says I acted groggy but I was just woke up im sure I was pretty groggy for a minute, I wasnt breath tested or dui tested in any way it says I smelled like alcohol but I just got out of bed before that all happened and diddnt take a shower or anything yet and still stunk like a bar from the night before but that was a whole day away. I should have just stayed in bed till it was closer to time to get up for work probably, any advice?

The back story being what? That you had been passed out in your car for so long, and were so unresponsive to attempts to wake you, that the police broke your window to remove you from your vehicle to see if you needed emergency medical care?

A good night's sleep does not magically make all the alcohol in your system go away.

If you were out partying the night before and were still so drunk you fell asleep in you car, you were certainly too drunk to drive.

I assure you, breaking your window was not the first thing they tried. It was just the thing that finally woke you up.

And I guarantee the car smelled like a brewery when the window was broken.

no I mean I understand that part I figure theres nothing that I can do to change any of that or expalin any of it, I was wondering what kind of defense I have for this or what should I do? This is my first offense of any sort.

Get an attorney.

If the car was running, you have a problem. If the car was in gear, you have a HUGE problem.

If the car was turned off, you may have an out.

yea it was off, I remember thinking to myself im going to rest my eyes for a few seconds and wound up knocked out
