US Born Citizen Engaged To An Illegal Immigrant Whose Visa Expired
I am engaged to my boyfriend of three years. He has been here illegally for about 4 years when he overstayed his Visa. Two years ago, he got put in jail for supposedly not paying a ticket (which in fact did pay and this was cleared up in court) and carrying an invalid california ID. The second time he was put in jail was for a DUI and he was out the very next morning, this was about a little over a year ago. He is still paying these tickets. We have gone through some rough patches but thank God we are holding strong. One rough patch right now is the fact that we're not financially well off. We can support ourselves but with extra fee's like that of processing his status to make him legal will be very expensive for us. We have already opened an account and have started saving money. We barely got engaged last month (april 2008) and that same month we opened up a savings account and a checking account. I have a new car and so does he, under my name. We have the insurance together as well. I am also thinking of buying a house with the help of my uncle. I am worried about the process of getting my fiance legalized. Any advise??

Since he came here legally, and then let his visa lapse, you can go ahead and get hitched, then get him all legaled up!
Get married, then you will need to file Form I-130 and Form I-485.
