    Resident Towed From A Visitor Spot
    My question involves a consumer law issue in the State of: Florida
    I came home last night to the apartment complex I live in and parked. They complex has all residents display decals on their windows to seperate them from visitors. I have the decal up but I parked in a visitor parking space. I parked in the space because my building is undergoing construction and has the entire lot infront of my building blocked off. Every other resident spot was taken and I had no other place to park. Am I at fault for taking one of the only spots available or is my apartment to blame for blocking off the spots and not providing more spots for residents?

    I would talk to the complex manager. Explain the reason why you were parked there. Then ask for reimbursement. If that does not work then you can always seek other legal avenues.

    But the question at hand is are you able to park in visitor parking spots. Even though you are a resident. Those spots are for visitors, how ever due to the circumstances you maybe able to be reimbursed for the tow.

    I've already attempted to talk to the manager and he has told me that I'm not get reimbursed. There is a sign posted at the front of the complex stating that visitors must park in visitor spaces but nothing about the residents. I've also checked the residents handbook online and it stated nothing about residents in visitors spots. The spots are poorly labeled and the lighting around the space I parked is horrible. I've taken pictures of the construction, hows its taken up all the spaces and i guess i'll head out tonight to show the lighting. Should I hide behind false threats of legal action or should I actually go through small claims court? Any other suggestions or help would be great. I'd appreciate anything.

    If the manager is not willing to help you on this. I would not make threats of legal action yet. But I would contact the Complex owning company. Basically the managers boss. When dealing with apartment complex there is always an owner of the property or owning company. I would contact them with all the info you have. See what they say. Then if you desire to go the next step.
