My question involves an eviction in the state of:
California
Signed a month to month lease with Tennant on 2/28.
Tennant has only paid partial amount of rent for Feb in then we agreed in exchace for clean up around the house he would not have to pay rent till April. Still cannot get in touch with tennant only with his brother who apparently began living there as well.
Heard from a reliable source that tennants brother who is not on the lease is planning on attempting to put some sort of lean on my house due to "repairs" he's made to property. This began when we verbally notified them that we were in the future going to be asking all occupants to leave as we are planning to begin renovations. We have not been able to get a hold of my tennant for quite some time. I have heard he is in jail and have also heard he is living some where else.
My problem is my lame husband cannot find our month to month agreement that the tennant signed. How hard will it be to get them evicted if we cannot locate our agreement? We plan to notice them in writing and then go from there hoping against hope that we do not have to actually go through the eviction process. We don't want any $, just want them gone to begin repairing the house.
