    My question involves real estate located in the State of: New York, Queens County. My neighbor has a tree and a rose bush that are inches from the property line. As the tree and bush grow they overhang the fence to my property but they also lean and sit on my side wall. (we have attached houses)

    I know I can cut anything that comes onto my property but don't they need to give me some sort of easement since my windows are on that wall? The true problem is I am getting insects in my house due to this problem. Our exterminator has verified this is the cause of our problem.

    We contacted our neighbors and got nowhere so I am looking for something in writing I can mail to them stating they need to keep the trees and shurbs off of my building.

    Sorry one more thing. I say they should be giving me an easement since in my back yard their 2 basement windows are sub level and the resulting hole comes onto my property 3 feet. I know I cannot block them.

    What type of "easement" are you talking about? Are you contemplating an easement that limits the type of plants they can grow on their own property that might attract insects? (There's no such thing.) What is the "resulting hole"?

    The holes are cutouts in my back yard so they can have windows in their basement.
    I am looking for a distance that they cannot have plants and trees against my building. Maybe easement is the wrong wording. Sorry for that.
