Careless Driving In Monmouth County, New Jersey
My question involves a careless driving ticket from the State of: New Jersey
My story takes place during memorial day with my sister and friends in Jackson, NJ, two traffic lights before the entrance to Six Flags Great Adventure. As I was driving towards the entrance, I see two police cars and a third car on the shoulder. Both police cars had its siren lights on. I was on the right lane at the moment and decided to switch to the left lane for the safety and well-being of the officers performing what I considered at the moment was a routine traffic stop. I proceeded with caution as I passed(secretly snickering at the pulled over driver), until I heard incoherent shouting coming from the police vehicles(my windows were up). I brake stomped immediately as an officer and his partner ran across the right lane to intercept me. I felt my tires skid, (no ABS) so I reapplied my brakes to come to a dead halt. I was told to back up onto the shoulder where I was ticketed for carelessness. The officer stated I almost ran him and his beloved sergeant over. I did not say not one word besides apologizing for not stopping quickly enough. I could not believe the overwhelming stupidity that this officer claimed I did. Arguing would be so useless, so I did not say anything to him and take it to traffic court.
As I was waiting for the ticket to be issued, one of the officers stood in the middle of the two lanes. He stopped, or tried to, oncoming cars for as a safety checkpoint for seatbelts. There were no indications or signs that I was suppose to come to a complete stop. There was no officer in the middle of the two lanes stopping traffic.
I have a citation to show for court but I also notice how the " required to show to court " box is left unchecked but yet a date was set for me. I am to call a number for more information for this court summons. I am pleading not guilty.
My argument:
- There were no signs or indication of an oncoming safety checkpoint.
- No officer in the middle of the two lanes.
- I proceeded with caution, slowing down below the speed limit.
- I changed lanes for the safety of the officers.
- (Not relevant) I completed a defensive driver's course the previous day.
- I had military tags on my vehicle and they still decided to ticket me on memorial day. Pathetic unpatriotic cops, the address on my driver's license is in Manhattan, NY, 10 minutes from the World Trade Center. I guess they do not like military personnel.

If you want to fight a ticket where you can expect police officers to appear in court and testify that you almost hit them, I suggest that you hire a lawyer to assist you.
