    What Would It Take To Move Out?
    My question involves juvenile law in the State of: Virginia


    Im 15 years old but will be turning 16 in december.
    My dad has recently passed away in august of 2007.

    I am now living with my mom during the week but staying at another lady's house every weekend.

    My mom bowls monday nights works tuesday wednesday & thursday and goes out with her friends on fridays. Therefore she is rarely home and I only see her for about 30 minutes a day when I arrive home from school.

    And the short amount of time that I do see here she always seems to be mad and we end up arguing.

    When I get home on sunday nights she is always telling me how she hates it when I come home, but when I try to walk out she won't let me.

    I have been wanting to move out for a while but cant figure out wheather i can or not and the conditions it would take.

    I have asked the lady I stay with on the weekends if it would be alright for me to move in with her if i got the chance and she said yes and that she will do whatever it takes to help me out with this and that she will come with me to court if thats how far this will need to go.

    My mom has considered letting me stay with this lady for the summer, if i stay there the entire summer will that help out with the court case to let me move in permanently?

    Virginia's emancipation law provides:

    Any minor who has reached his sixteenth birthday and is residing in this Commonwealth, or any parent or guardian of such minor, may petition the juvenile and domestic relations district court for the county or city in which either the minor or his parents or guardian resides for a determination that the minor named in the petition be emancipated. The petition shall contain, in addition to the information required by § 16.1-262, the gender of the minor and, if the petitioner is not the minor, the name of the petitioner and the relationship of the petitioner to the minor.

    but im not 16 yet, what can i do since i am only 15?

    can i get some sort of legal guardian change?

    Okay, so if i happened to talk my mom into signing for me to live with this other lady, could i write/type up something for her to sign and take it to court or would she have to come infront of a lawyer and sign me over and show up in court

    She is going to grant guardianship to the other woman.

    There are forms available at the courthouse.

    You should have the talk with mom before making the trip.
