A Guest Or A Tenant? What Are My Rights As Property Owner
My question involves an eviction in the state of: Illinois
I was divorced in 12/2005. As part of the sttlement I am obligated to provide "household support" until the marital residence is sold. there are provisions in the decree regarding listing and selling etc. Due to the uncooperative nature of my ex, the house has not sold (nor is it even currently listed) The decree is silent on the issue of possession, not granting possession of the house to either party. My ex moved her boyfriend into the home in January of this year. His possessions are in the house, and he has registered his car to that address. As 1/2 owner of the home, and due to financial constraints caused by supporting two residences, I intend on moving back into the house when my current lease expires in September. My ex obviously will object. However, I assume legally I have rights to use of the property since the decree is silent on possession. My ex is clearly engaged in delaying tactits on the sale. My question is, I beleive, I can reasonable prove that her BF is not a guest (given the presence of his possessions and the registration of his vehicle to the residence.) Given this, I assume he leagaly assumes the title of tenant. As he is not contributing rent, can I file an eviction notice?

Without an court ruling your in limbo so to speak. Contact your Attorney and get a court order
