What Happens If You File An I-360
Hello,
I just have a question about I-360.
My LPR husband and I have had a rocky relationship. I love him, and he always says he loves me, but he gets drunk a lot and things aren't always that well.
He petitioned for our I-130 2 years ago, and we overstayed here because he didn't tell us that that would happen. He doesn't want to sign any other petitions, didn't want to do a K-Visa or anything, and in effect we feel trapped here.
So one of my friends recommended that I file the I-360 to be able to control our I-130 by ourselves, and to be able to work under the protection visa that I-360 gives.
However, I would also feel guilty if anything happened to my husband. Though I want to leave him, I don't want him to be deported or anything. Hes an LPR of 18 years, with 3 DUIS and 1 DV charge.
If I were to file the I-360 and had it approved, do you know what would happen to my husband if he didn't contest it? Would he be deported? If he was taken to court, would he be able to atleast waiver being deported?
Or will nothing happen?

You are speaking about trying to get a Green Card for yourself by claiming to be a victim of domestic violence? Are you a victim of domestic violence?

Though I don't think this is the place to have to prove it, yes, I am.
I have all the necessary documentation ready, my lawyer is ready.
I just want to know all my options because even though I want to leave my husband, I don't want to anything great to happen to him, that is why I am asking of the ramifications for him should I file the I-360.
