Employer Wants Money After I Quit Before End of Contract Term
My question involves employment and labor law for the state of: Texas
I signed a contract with my US employee to work for 3 years on H1B Visa. But after 2 years, I left the company in happy terms and every thing was fine till now. But yesterday (after one and half year of leaving company) I received a letter from my employee that I need to pay him $ 45000, because I broke the contract. I want to know that, can he still sue me after such a long time.
Please please suggest, what should i do?

Probably yes. I don't know if there is anything in your contract as to a certain period of time that a claim for breach of contract can be filed after the breach (sometimes contracts will have a shorter SOL than the one that would normally apply). I believe in Tx. a contract cannot shorten the SOL to less than 2 yrs. though.
I believe you need the help of an attorney if you might be sued - have them review the contract.

The contract may not be enforceable, as it sounds like the amount is intended as a penalty as opposed to reasonable compensation for the original employer's expenses.
