Domestic Battery??

My question involves criminal law for the state of: Kansas.

I recently was involved with a Domestic Battery where the person involved was a friend (not a family member) who said we were brothers to attempt to alleviate the problem. It didnt work and i was takin to jail for about 8 hours. This is my first problem such as this, i do have multiple duis. What should i expect???? Thanks for any help you can give!

I have not had court yet but my ticket reads DV Battery. Yes there was a fight and it was at his house. This occured on my 21st birthday and we were both intoxicated. We are both on speaking terms as well.

no i live in a different part of Kansas City, technically a different city.

My friend did tell the officers we were brothers but we were both drunk. I was informed that domestic battery's can not be dropped by the person who was "battered". If my friend does not want to press charges does that help at all??

Could i technically be convicted of domestic battery if we have no relation other than friends??

I believe you should have been charged with 21-3412. Battery. It is still a class B misdemeanor though. They are charging you with the DV because of the false information.

It is out of your friend's hands - it will be up to the prosecuting attorney as to whether or not the charge will be pursued. You should consult with a criminal defense attorney in hopes of getting it reduced to a lesser charge.
