Neighbors And Quiet Enjoyment
My question involves landlord-tenant law in the State of: Maasachusetts
We have a two family home in Massachusetts and this question has to do with our neighbors. We had new neighbors move in approximately five years ago. For the past three years they have been "re-modeling" their back yard. There is a constant stream of activity morning to night 7 days a week with an associated amount of construction noise and dust. Our tenants (on the first floor) have finally started complaining about the noise and dust/dirt from next door. They can no longer open their windows on this side of the house (bedroom and kitchen) due to noise and dust/dirt, and the non-stop noise is threatening their right to "quiet enjoyment" of the apartment. We have spoken to the neighbors on several occasions but this has not helped. We have even had the police over twice to speak with them, but this only resolves the problem for a day or two and then they start up again. And we have had the Board of Health and the local Building Inspector over. Again with the same results; work stops for several days and then it resumes. Lastly, the construction in their back yard has caused an increased amount of water in our basement due to the grading (or lack of grading) and we now have a rodent (mice) problem that appeared in conjuntion with their back yard construction.
What are my options: injunction against the work, file a cpmplaint (94a?), etc...

If they are trespassing, then hire a lawyer.
