Re: False Kidnapping Report
I am not even sure I followed that.
So... a bum jumps into your car and stole money from you.
Why was the bum in your car? Did he usually buy you alcohol or something?
Re: False Kidnapping Report
Maybe I din't made statement clear. Sorry for that. What I tried to say was that a man (a homeless, bum , an addict, im not sure of the adecuate term here) i used to know went for my money after I withdrew it from an ATM, so he did rob me. The thing is that the man actually got into my car with my consent (meaning he didn't force his way in, I actually acorded on giving him a lift or ride to a place he needed to go). Obviously, he got into my car previous to the ATM incident. This also means that the man was caught by the ATM camera. My error was to say the man actually "got into my car" (or simply kidnapped me). The case is in a very early stage; the officer working my case hasn't even cited me for proper identification of the man on a line up. All I really wish to do is to drop the charges, but I'm not sure how to do it. The thing is the man has a criminal record for similar actions (armed robbery), and the evidence (ATM video tape) is quite convincing. He has no way of proving he was there with my consent. Im think this case is in a very early stage. what can I do to end it?
Re: False Kidnapping Report
You are not answering my question.
Why was the homeless person in your car? And what was the money for?
See, the problem here is that not only I but the cops you are dealing with weren't born yesterday.
Here is what I am thinking happened....
You use a bum to buy you alcohol by letting him get something for himself.
This time, you picked him up to go to the liquor store and stopped at the ATM. At the atm, the bum decided to just take all the money and buy his own booze.
You immediately got ticked off and called the cops and made up the most outlandish story you could. Then you started thinking... man, when that bum talks to police, I am going to be in a lot of trouble for all the booze I had him buy me.
I better change my story and drop the charges.
How close am I?
Doesn't matter. The arrest and case are in the hands of the DA now.
Re: False Kidnapping Report
No No... I dont think we're understanding each other. You're taking my word when I use the term "BUM". If it helps, lets eliminate it. Lets refer to it as simply a man. These was not the scenario in any way, so please leave your forensic analysis and stick to what I'm telling you if you can so that we can understand each other. I think I'm using the term BUM for a person who maybe isn't that. It was simply a man. I know this man, not by name, not because we have a relationship, but simply because he wanders in the area I lodge (students here give him food, or try to help him or any other). The thing is the man seem fairly "clean" to me (if it this wasn't true, i woulnd't let him in my car) (once again, forget about the term bum, homeless, whatever). On my way to take him to where he asked me for, I stopped at an ATM machine to withdraw money for MYSELF, but on that instance, he took it from me. This was caught by the camera. HE DID ROB ME. The wrong part here is that he didn't got into my car by force. Get me? This is what I told police. This means kidnapping. i'm actually trying to fix this. Nothing has been done to the person yet, not even proper identification of the suspect. I only got to identify him on a mugshot when I went to the police. Is there a way I can stop this? Drop Charges? You get me?
Re: False Kidnapping Report
By the way, i was taking him to a cople of blocks away from the initial place we encountered. Maybe he live there. I didn't care. Was it stupid? Yes, problably; taking a "stranger in your car". But I'm here trying to seek advice form people who may help me FIX THIS. Oh and by the way, If you weren;t born yesterday then you should be aware that the legal age to drink and smoke in the state or commonwealth of Puerto Rico is 18.
Re: False Kidnapping Report
The bottom line, regardless of the scenario, is that you have reported a crime to the police. They have a duty to investigate and take whatever steps are indicated, which might include identifying the suspect and turning the case over for prosecution. Then the prosecutor gets to decide whether or not to bring the case to trial or offer a plea. At this point, you are nothing but a witness.
Re: False Kidnapping Report
Good to know that. Now, how do I stand here? I mean, am I in the position to state that I'm not interested in following the case? If so? To who will I want to say this to? Am I in the position of dropping charges? When the police agent calls to cite me for identification of the suspect, can I state I dont want to continue? I apreciate your inputs.
Re: False Kidnapping Report
The case is now in the hands of the DA.
Any further action or inaction is up to them.
