    Change Of Last Name Without Parent Consent
    My question involves name change laws in the State of: Texas

    I am inquiring about changing my son's last name to mine. I am aware of who his father is but he has not seen or been in his life at all. He did not sign my son's birth certificate and his name does not appear on it. He has shown no interest in him and I was wondering how to go about changing his last name and was hoping that I would not have to contact my son's father in order to do so. I have never filed anything with the attorney general for child support and do not wish to ask for anything from the father. My son is 3 years old and I want him to have my last name once he begins public school. IS there any way to do this without having to file a petition or appear before court or a judge?

    Generally, an attempt to notify any possible father is required before a petition for name change can be granted. You should get a short consult with a local attorney to find out what the requirements are for your area.

    I just noticed that apparently your last name is not the same as your child's. Are you married? If you are, does your husband wish to adopt? If so, that might be the best way to go.

    To answer your question, I am not married. I am a teacher/coach for a high school here in texas and I am a single-mother. I had hoped that my son's father would take responsibility and at least want to know him and see him but sadly,that just didn't happen. I really don't even have too much information about him because after my unexpected pregnancy things didn't end too well. He did come and see him when he was a week old but after that, I never heard from him agian. I know that he has two other children that he apparently saw from time to time but I never met them or their mother. I would just like some advice as to where I would even begin. I wish I had not given him his last name to begin with, but I was torn with a decision and made the one I thought was best at the time. It wasn't the right one though.

    You should get a consult with a local attorney who will know the steps you must take to notify the father.
