    Am I Eligible For UI If I Don't Agree To A Work Reduction
    My question involves unemployment benefits for the state of California:


    I have been at my job for 2 years. Due to declining business, my work load was reduced from 40 hrs/week to 32 hrs/week about 3 months ago (with a 20% pay cut). Since then, my employer informed me that at the end of May my work load will again be reduced to "as needed" basis (and paid on an as needed basis) through July/until my work closes it's local office.

    My question is this: If I do not agree to continue working on an "as needed" basis, will I still be eligible for unemployment insurance?

    Its up to state to make that determination. However since you are declining work I suspect you would not qualify. What you can do is accept the reduction and file for UI due to reduction. Some of your lost wages can be made up that way

    Even if the position changes from full-time to part-time?

    This seems counter-intuitive to me. If I can't decline the new employment terms then my employer has complete control over me because I have to say yes to whatever terms they decide or not get UI. In other words, if my employer tells me I am going to work one hour a week I have to say yes or not get UI?

    Is that really the case?

    I am losing my job completely, but my employer is trying to string me along without laying me off for the last few months.

    Your really not paying attention are you? First off State makes ruling noone can say for sure but based on what I know if you decline work you cannot collect UI. Now this is not end of world you can still file and collect UI because your wages are reduced. During those off hours you can seek new employment. Your "best" option is accept the reduced hours file for UI and seek new employment. This keeps money coming in. Quitting could give you nothing

    Let me understand you correctly.

    You refuse available work so that instead of some income you have no income. And you think the state should pay you for that?

    I haven't checked your state but some states allow you to file, and recieve, UI if your income drops below a certain level. I'll let you research that possibility. and yes, even while you are still employed.

    No need CA is one of those states, which is why I said what I did about filing
