    Do You Need A Divorce or Annulment When A Spouse Is Missing
    hello, newby here from australia.
    my 2 sons and i were watching a re-run of "cast away" with "Tom Hanks" (great film by the way) and my youngest lad asked me a question i could not answer, does "Kelly" Chuck's wife (played by Helen Hunt) get an anullment or a divorce automaticly when all hope is lost in finding her husband, because in the film she has remarried with 1 child. i would imagine that the laws would be similar in australia. could someone shed some light on the subject. thanks

    There is nothing automatic in the law.

    If somebody obtains a death certificate on the basis that their spouse has been missing for a number of years and is presumed dead, they don't also need to get a divorce or an annulment.

    In the movie they were not married when his plane crashed. He was going to ask her to marry him when he got back from that flight. Too bad she didn't wait for him ;)
