Can I Be Employed Full Time By Two Companies At The Same Time
My question involves labor and employment law for the state of: California
I am working as a permanent employee , full time at a company. I plan to resign and join another company.
I may end up joining my new company while I have still not yet resigned from the old company. This overlapping situation will be only for 2-3 days at most.
Is it illegal to be with two companies , full time at the same time?
I will be getting paid by both companies during this time.
I checked I-9 form and it does not say anything anywhere about being working only full time only for one company.
Re: Can I Be Employed Full Time By Two Companies At The Same Time
There is nothing wrong with working for two different companies at the same time.
The only thing you maybe doing is breaking company policy. But that would depend on the policy of the companies.

There shouldn't be any big deal/problem here.

No. There is no law preventing you from working for as many companies at once as you can reasonably handle without dying from sleep deprivation.
If you're only going to be doing this for a couple days, the only thing you really need to worry about is scheduling conflicts.

I should hope so. That's why it's called "work" and not "vacation".
Re: Can I Be Employed Full Time By Two Companies At The Same Time
There is nothing in the law prohibiting you from working for two companies at once.
There is also nothing in the law prohibiting one or both of these companies from firing you for doing so.
The law simply does not address the matter.

I didn't mention that since it is only for 2-3 days. However, you are correct, the OP could be fired by one or both cos. due to working for both.

I would also spend a second going over any non compete documents you signed with your present company.
While most courts try to give the employees and "out" on a NC, working for the competitor while still enjoying access to your present company may be too much to overlook.

Thanks for all the replies. This helps.
The two companies are not competitors at all. So that should be okay.
Also I don't mean to do this to cheat any company. Its just that I plan to announce my resignation on Friday from one company. And start work following Monday with the new company. So if the first company takes 2-3 days to react to the whole thing, it may mean that for those 2-3 days I am employed at both place.
Thats all.

Make your resignation effective immediately.
Two weeks is the standard, but there is no law around it.
