Life Insurance And Divorce
My question involves divorce in the State of: Oregon My wife and I have been seperated for about 7 month when her father died. he had a life insurance policy on himself and the premiuns had been paid by him up until he could no longer make the payments. At that point my wife and I made the premiuns for a whole year before he died. my question is is that conciderd to be commingled funds an I am intitled to half or some portion of the life insurence. She says no.

Are you named as beneficiary?

It doesn't matter who paid the premiums. Who is the beneficiary - is it your separated wife & only her? Life ins. passes outside the estate (if there is one) & goes to the bene named in the policy to do with as they wish.

I might add life ins. proceeds are considered separate property by the courts in non-community property states & even in community property states (Oregon is non-community property).
