Wife Cannot Work
My question involves bankruptcy in the state of: Louisiana
My wife developed a lung disease and cannot work. Can this be considered a special circumstance to help me quality for a chapter 7. The attorney I talked to seems to be pushing for a chapter 13 with her income included. If her income was included, I would not even be in this situation.

Does she have any type of income? Did your lawyer say you don't qualify for a chapter 7?

Yes, wife has income. I have taken the means test online and looked at a few senerios. With my income and my wifes income, I am over median and fail means test. In six months, my income alone is over median 15K but I pass the means test when I include my house note. The lawyer I talked to said you cannot file BK7 if you are over median, no matter what the rest of the means test said. Is this true? I do not feel like he is being entirely honest with me. I am planning on talking to a different lawyer soon. Anyway, there are some other questions I would like to ask.
Do I have to include my kids part-time jobs as household income?
Can I be forced to cut cell phone and cable bills to make room for extra money to pay BK13?
Can house note be used in means test?
I think I will wait six months to file but would like to be sure I qualify for CH7.:wallbang:

If your wife is not expected to be able to return to work, she should be seeking Social Security benefits. Also, if she doesn't already know, she should check to see if she has any long-term or short-term disability coverage through her former employer.
