    Want To Marry A Woman With Children, But Landlord Doesn't Want To Let Them Move In
    My question involves landlord-tenant law in the State of: Arkansas.

    I have a one year lease on a home in the Hot Springs area. I have been a model renter, always paying my rent on time, or early, and been very quiet and respectful. At the time that I signed the lease, I was told by the property management company that "it shouldn't" be a problem to add family members in the event that I should ever marry.

    Now, I find myself in that exact situation, I wish to marry a woman with children any the owner does not want to let me bring her children in to the home. What are my rights? Are there any legal precedents that would either be in favor or against my right to do so?

    The Landlord does not have to allow anyone else in dwelling if landlord so chooses. The lease has you rnam eonly on it there fore you are bound by its terms. How big is this dwelling (bdrms).

    3 Bedrooms 2800 Square feet, PLENTY of space. Also I would have to disagree. The HUD Fair Housing Act prevents discrimination against tenants with Children simply because the Tenant has children.

    I would welcome any other knowledgeable opinions regarding this matter.

    How many children? I will again add that your lease currently has only you on it. The landlord has no obligation to rewrite your lease until after it expires

    GreatRenter, is the sole issue here that the landlord doesn't want any children living in the house, or is there an issue with the number of children? How many children would be moving in?

    You are renting a stand-alone home - a single rental unit, not part of any larger rental development owned or managed by your landlord, and not subsidized housing?

    4 children, plus the two of us in 3 Bedrooms is two people per bedroom, which by most standards should be acceptable. It is a detached home, not subsidized, not part of a bigger development owned by the landlords. It is 3 stories, and the main issue is that the owners are older and is concerned that the kids will wreck the place. I have even offered to bump my security deposit.

    What are my rights as a renter?

    Your Landlord does not have to alter or change the terms of your lease if he does not wish to which appears to be case. Once your lease expires then you have a fair argument

    GreatRenter, again, is the sole issue here that the landlord doesn't want any children living in the house, or is the issue with the number of children?

    Does your lease mention a maximum number of occupants?

    I think it is probably the number, and also that the Landlord is concerned that the children might damage the proerty. I guess I can try and see if he would accept an outrageous security deposit like 3-5K and see if he will go for it. With three Bedrooms, I should not be in violation of any Zoning occupancy guidelines, because I believe that 2 people per bedroom is generally acceptable. Neither the lease nor the local CCNR's state any maximum, only that "all persons living in the property must be approved by the owner and the property management company".
