    My question involves bankruptcy in the state of: NY
    I will file for chapter 13 in about two weeks. I need to pay for my attorney and other things. I do not have the money and if I do not pay my attorney, it will take months for me to file. I was wondering if I could make a 401K hardship withdrawls which I do not have to pay back to pay for those expenses. Once I get the check from my 401k, will my checking account checked if I deposited the check? Will I have any problem?

    You might want to run this by your bankruptcy attorney.

    EXACTLY what are you planning to use the 401k monies for? Under the law, 401k hardship withdrawals can only be made for extremely limited reasons, and they DO check.

    I want to use it to pay for my school tuition but I will use part of it to pay for my attorney's fees.
