My question involves criminal law for the state of: Texas
Well I have a question, this past march a guy liked me and he came to visit me at work and stuff and one night tried to kiss me but i moved away a week later i guess we were friends and we hungout at his house. He is 25 and I was 17 at the time. He picked me up and took me upstairs and i said NO that i didn't want to do that because I was a virgin and i was scared out of my mind. That next friday we went to the movies and after that went back to his house and again he lead me upstairs he started taking my clothes off and i didn't know what to do so i just let him. I didn't want to have sex with him i told him No the last time so this time was no different except he pulled down my pants tore my zipper in the process and he had sex with me.... He took my virginity. While he was doing what you know they do I started crying and I felt awful. He didn't see me cry. After it was all over I put on my clothes an went to the bathroom i looked into the mirror and felt horrible. I felt gross used. Was I raped he is 8yrs older than me how could he do this to me and it turns out that he is sckitoprenic and now I'm terrified he keeps calling my house and Im so scared. I haven't told my mom that he had sex with me but I have told her who he is and stuff. But I want to file charges but its been about 2months and Im now 18 what should i do was it statutory rape?? Or was it ok for him to do what he did?

Of course it was not okay for him to do that. You said NO!! No means No wether you said it once or not. He should've known better. I don't know if it's too late to report it but I would, and you should talk to your mother about it. It may not heal you but it will make you feel better knowing your mother is there for you. Yet, I don't know what kind of relationship you and your mother have, but if it was me I would tell my mom. My mother is my best friend. She knows everything about me and everything that goes on in my life. You shouldn't be afraid to tell your mother anything at all. That's your mom and I know she'll help you get through it. It's not your fault he did this to you.

Yeah, but who knows what was going through her mind. She was probably terrified to do anything......it could've set him off. None of us will know because it was not us that was in that situation.

Where I agree there was no actual consent and arguement can be made there was implied consent when the young lady did not stop him the second time.

Sorry, I have to agree with Senior Judge on this one. The OP stated she said no the FIRST time, however, on the second occurrence, she said/did nothing. Implied consent - if she said nothing, then she gave her consent. There was no rape here, only 2 people having sex.
On a more personal note from one woman to another. Sweetheart, when a man attempts to disrespect you the first time, don't give him another opportunity to do it again. When he acted inappropriately with you once, why in God's name did you go out with him again? -

You can always talk to a sex crimes detective and let them determine.
You can always talk to someone on a victim hotline.
I had a close friend of mine lose her virginity this way and it was terrible to even think about it. She spent years dating different guys and could never really tack down a relationship. She was punished for something that was the fault of St--------.
I can no longer advocate violence (though I sure could do so as a teen); her big brother took care of the issue in lieu of bringing the police in on it. He was actually the cooler head that prevailed.
I have a close friend that had another close friend pet her heavily. Then, all of a sudden, he was inside her. She had never told him no and there wasn't much that she could do about it.
...and there is something REALLY WRONG when a 25 year old man pursues a 17 year old girl. I even felt creepy when I was at a college with friends (at 25) and hung out with an 18 year old and a 21 year old. They were college "kids" and the 21 year old showed interest. Granted, I am the same guy that felt creepy as a Senior and getting hit on by a Freshman. -

You will not get in trouble. He will not get in trouble.
But if your mom wants to do something, she can sit you down and have a talk with you about responsible dating. She seems not to have had that discussion with you yet. She can also talk to you about boys being with you in and around beds, which is another place they shouldn't be, nor should you be with them. There is a WHOLE LOT she can talk to you about, none of them have anything to do with sending this boy to jail, but more to do with helping you develop into a responsible woman.
