17 YR. Old Getting Out Of House Without Emancipation
My question involves emancipation laws for the State of: New York
Ok heres my story. I have been dating my girlfriend for a very long time I am 17 and my girlfriend is 17 as well and will be 18 in 5 months. Her parents are neglectively abusive, abuse marijuana and crack cocaine,have been arested numerous times, and also make her babysit at least an hour a day, her one year old brother as though my girlfriend was raising him. They Currently will not let her see me because she was so scared to go home one night that my mom didnt want her to go home because she was worried and knows how her parents are. So she called the local police and asked if anything could legally be done to bring my girlfriend back to her parents, they responded no she is 17 and considered an adult. Long story short the cops still came to my house and removed her and she left with her father. My mom abrputly contacted the police again and they still continued to say it couldnt have happend and my mother was talking to a litenuent! I have looked into emancipation for her and would go either live with a relative or live with me and my family untill we are mature enough to get an apartment. A relative or my house are both stable environments and pose no threat unlike her house. Her parents are running from expenditries that they owe for bail money and other allegedly other various reasons, and are moving to Rhode Island within the month. I am aware that emancipation would take untill she was 18 let alone before they go to RI. What could I legally do to get her away from her parents with either a relative witch all of her mothers siblings strongly agree with me or my house. I would conact C.P.S but my main concern is the time frame with the moving. What can I do? Thanks. F.Myers

Contacting CPS is the only option anyone has in this situation.

There is NOTHING that you can do to get her out of the house. You have no legal standing to do anything except possibly call CPS on her behalf.
I can promise you that no judge in any jurisdiction is going to order any teen, no matter what her circumstances, to be placed with her boyfriend's family. One of her own relatives, maybe. With you and your family, not a prayer.
NY does not even have a statute for emancipation, btw.
At 17 she is not a legal adult. The local police may or may not pay much attention to a 17 year old leaving the house without permission but legally, if her parents kick up enough of a fuss, they will. She cannot LEGALLY leave the house without permission until her 18th birthday. After that, she can go wherever she likes. At the same time, her parents have no legal responsibility, once she turns 18, to pay a single penny towards her care.
She will not be allowed to stay in NY when her parents move to RI unless her parents give her permission, and even if they do, that permission can be revoked at any time they choose until she turns 18.
Are you getting the idea that as long as she is still a minor, her parents are God?
