Abandoning LPR Status, And Returning As Tourist
Hey everyone.
I am a Dutch citizen and held a GC from 07/02 until 05/07. My USC wife and USC daughter and I have lived in the Netherlands from 05/07 till now. My GC and re-entry permit are now expired.
We want to move to the US and my wife and daughter are currently in the US to spend some time where we're going to live.
My wife has a resident permit in the Netherlands and we want to file an I-130 petition through the consulate here when they're back (DCF).
My question is; I would love to fly out to them to check out my new place as well, but I would have to officially abandon my status as a LPR at the consulate here in order to travel to the US as a tourist.
Would I jeopardize anything if I abandoned my LPR status at the consulate, flew to the US as a tourist, came back with my family and then file the I-130 here?
What if they denied me entry at the POE, would that jeopardize our future I-130 application, or is it just smarter to not visit the US before a new GC application is approved here?
