    Failure To Stop And Give Information
    My question involves a traffic ticket from the state of: Texas


    so A couple of weeks I was charged with FSGI (Failure to Stop and Give Information). I was token into custody and was taken to county since i am 17. but i was only in the holding Tank for roughly 8 hours then i was released because something was Rejected, i forgot what he actually said. but before i was taken in the cop told me i was looking at a max of 6 months. my court date is coming up on the 20'th of May. All i did was hit a mailbox with my car and drive off in the neighborhood. I don't have a license. so can anyone help me out on what i may be looking as in fines or time i may have to serve? is it a possibility that i may get probation? o and if it affects anything a week before this all happened the same cop that arrested me stopped me for no license no insurance and out of date stickers. so now i have to see the same Judge Twice. the court date for those are coming up on the 13'th of May. Thank you for anyone who helps me!!!

    You mean in addition to the bit where you have neither license nor insurance and were already busted for that?

    I wouldn't count on probation, particularly if you toss up "All I did" to the judge.

    You'll want a lawyer. He's the only one who can answer your questions with solid information, all we can do here is guess, and I don't think we've got a functioning crystal ball in the house at the moment.

    ...unless you are innocent and can prove it beyond the shadow of a doubt, you did a crime and have to pay the time.

    Unless you are a smartass to the judge the jails and juvy is bit overcrowded to chuck a 17 year old kid in for 6 months. That mailbox could have been some soccer mom's 8 year old daughter or son. Judges are the ones that make sentences; even if they have a guideline they will be the ones that ultimately determine your sentence in traffic court.

    In my DUI I was "looking at 6 months" because that was the maximum charge. Realistically, because you are 17, for starters you are looking at restitution to the homeowner, and likely a lot of community service, possibly some juvy time, a year or two of probation, and a few hundred to a few thousand in fines (in addition to restitution). They will likely tack up the charge of driving without a license. ...a license that's easy to get if you do a little footwork ahead of time. ...and they will likely say that your inexperience shows that you are not entitled to a license and make part of the plea deal that you go to a driver's education scool.

    Get an attorney, take responsibility, get your attorney's OK to make restitution now, save your pennies (and your parent's dollars), and get ready to walk to/from college and work for a little bit. When your attorney makes a good plea deal, take it.
