Kohls Civil Demand
today i got caught shoplifting cloths at kohls in ca. i left the store and went to my car when the police pulled up and stoped me they said kohls had me on camera shoplifting.the loss prevention agent came outside and id me. one cop arrested me and took me to jail, while another cop took my id and info inside the store with the lp.after sitting in jail a few hours the cop that went in the store came and got me out of my cell and took me to an interview room where he read me my rights and said he whatched me on video shoplifting he knew everything i took. he ran my backround and found i had a past conviction for shoplifting in another county and said i could be charged with a felony but wrote my citation for pc484 a misdermenor my question is could i be charge wiht a felony when i go to court also since i was never taking back in the store could i still recieve a civil demand because the cop took my id and info in the store with the lp does anyone have the # for kohls civil recovery department any info would be great thanks

You were caught stealing, so you can be charged with an appropriate offense based upon your offense. I have no way of knowing what charge a prosecutor will authorize. If you think it will be a felony, hire a criminal defense lawyer to assist you.
The civil demand can be for the retail price of the merchandise (if not recovered in merchantable condition) up to an amount not to exceed $1,500, plus a penalty not to exceed the greater of five times the retail price of the merchandise or seventy-five dollars (but no greater than $500).

You are looking at at very least a second offense charge which could mean jail time. You need an Attorney and pronto. Its not likely Diversion will be option due to this being a second offense
