    My question involves criminal law for the state of: Washington

    Hello,

    A friend was molested when he was between 7 and 10 and he is now 32. Is there a statute of limitations for prosecuting? I've reviewed the RCW codes and according to them, this falls under the '9A.44.083 Child Molestation in First Degree Any person who engages in sexual contact with any person under 12 years old and where defendant is at least 36 months older than victim. (Class A Felony)'

    It is his grandfather that did this to him and now his nephew is living with this older man and the victim is afraid that the...bad guy (can't think of the proper word) will do it to his nephew. Just to muddy the water a little more, the nephew is my stepson and we're fighting for custody as the mother - the victims sister - knows of the molestation, doesn't care, and routinely hits my stepson, among many, many other vile things. Any advice or suggestions? Oh and CPS doesn't care - we've called on numerous occasions.

    Limitation of actions

    (c) Violations of the following statutes shall not be prosecuted more than three years after the victim's eighteenth birthday or more than seven years after their commission, whichever is later: RCW 9A.44.073, 9A.44.076, 9A.44.083, 9A.44.086, *9A.44.070, 9A.44.080, 9A.44.100(1)(b), or 9A.64.020.
