How To Get A Conviction Overturned
My question involves criminal law for the state of: Georgia
I would like to find out if there is anyone out there that might be able to help me find out what the procedure is for trying to get a conviction overturned. I have a case that has been brought to my attention and I am trying to help them out as much as possible. The person that is involed had an arrest warrant served on him and the warrant that he was arrested on violated U.S. Code Title 15> Chapter 41> Subchapter II> Section 1673. In this code
c) Execution or enforcement of garnishment order or process prohibited
No court of the United States or any State, and no State (or officer or agency thereof), may make, execute, or enforce any order or process in violation of this section.
I can get proof that his convictions stemed off of an order that voilated this. Please tell me where they should start. They want to get this stuff taken care of.
Please any help that you can offer would be great
Re: How To Get A Conviction Overturned
The person can have their attorney file an appeal ... if still within the statutory time provisions.
However, even if the arrest was bad, that does not mean the case was bad. One can have a bad arrest and still be prosecuted and convicted for the underlying offense.
He or she needs to speak to an attorney who handles appeals.

What can you do for them?
If you are an attorney (and you would be familiar with the appeals process) you can review their case and the appeal timeline that they have, getting the appeal in well before the deadline to file said appeal.
If you are a friend or boyfriend/girlfriend or family member, you can give as much as you have to the best attorney that your money can buy.
