    Is It Easier To Get A Fiancee Visa Or A Spouse Visa?
    My fiancee came here 6 years ago on a visitors visa. He applied for asylum and was denied. He has been appealing the case, and has a notice of deportation, that was never communicated to him by his attorney. The INS came to his house about 3 weeks ago, and now he is being detained an immigration facility. We have hired a lawyer that filed paper for a petition for a bond, petition to re-open the case, petition for stay of removal with state and federal courts. It will take another 2 or 3 weeks to hear a decision from them. In the meantime, we are praying for the best, but also making a game plan in case it doesnt work out. He has no criminal record, and I am a US citizen, and we have no children. If he does accept their offer for voluntary deportation, what would be better for us to do? Get married and apply for a I-130or K3 or remain fiancee' and apply for a K1 visa? Which would be better to get him back into the states as quickly as possible?

    He's in the process of being deported? This is something he needs to be discussing with his immigration lawyer.
