Name On Birth Certificate
My question involves name change laws in the State of: Ohio
My future wife lives in OH and is carrying our child. However, she is still legally married and was told she cannot get divorced until after the baby is born.
1. Is this accurate? Filings had begun prior to conception
2. Can my name be on the birth certificate as the legal father or can she just leave it blank until paternity is confirmed?
3. Can the baby have either my last name or her maiden name?

Unfortunately, you are NOT the legal father. Her husband is.
