    Repayment Of Chapter 13 Plan
    My question involves bankruptcy in the state of: Ohio
    I filed chapter 13 In Sept. 2005. My plan was for a 17% payback. All Secured creditors have been paid in full 100%. Unsecured have been paid on the agreed amount. No payments have been paid to any of my creditors since 12/07. Will my plan close after 36 months. My plan was set for 60 months.

    You need to discuss this with your bankruptcy attorney and your trustee.

    We're not familiar with the details of your case, and can't make an informed guess.

    The Trustee can provide you with a status report that will show how much has been paid to which creditors, and which creditors did and did not file claims. If unsecured creditors failed to file a claim by the deadline and were properly notified of the BK, then they are essentially out of luck, and if this is the case and all of the claims filed in your ch13 have indeed been paid according to the terms of your plan, then yes the case can close after 36 months. Don't stop making your payments though until you receive notification from the Trustee that the case is closing. Best thing to do is request a telephone appointment with your BK attorney to look over a status report and discuss your case so you know what to expect.
