Expunging A First Time Drug Possession Misdemeanor
My question involves criminal records for the state of: Virginia
In September of 2006 I plead guilty to a reduced charge possesion of drug paraphenalia (down from possesion of marijuana - 1/2 a joint). At the time I thought I was doing the right thing, but now I have a misdemeanor that shows up on employment background checks. After finding this out, I did some research and see where VA code 18-2-251 provides 1st time offenders the ability to perform some different steps to take (drug screening, education programs) - and then it appears nothing will show on their record.
Can I appeal my conviction somehow (since this was my 1st offense of any kind anywhere) and perform the above steps to get this charge expunged?

Given that this was a plea bargain and more than 18 months have passed? I very much doubt it, and would expect any process of trying to reopen your case to be costly. Ask your criminal defense lawyer.
