Shoplifted But No Police Came
My question involves criminal law for the state of: Colorado
Although I do not like to admit it as we all do not...but I shoplifted from Wal-Mart the other day. I was taken to a room where they collected my information and said I'd be getting a bill for between $100 - $250. Yet no police came...so does that mean I won't have to go to court? Or can I expect to get a court summons in the mail?
Long ago as a minor (10+ yrs ago) I was charged with shoplifting but the police came and gave me the court date at that time. So two questions...
1) Will I have to go to court?
2) If I do go to court am I going to have to go to jail or have a harsher sentence because this is a second offense? Will my charge as a minor even show?
I have been reading some other posts about Wal-Mart's new laws, etc.. but still can't figure it out. My total merchandise stolen was under $25.
Any advice would be helpful to alleviate some concerns.

Okay, so really my main concern hear is going to court...
Does the fact that the police did not show while I was there mean there was no police report filed? Or can the LP still file a report even after I left?

The theft report can be filed at anytime within statute of limitations

So basically it is still a very likely possibility that I will have to go to court, even if the WalMart LP only said I'd be getting the Civil fee and nothing about criminal charges?
Also, would I be getting the court summons in the mail or do the police actually show up at my door?

If Walmart told you they were not pressing charges then its likely they are not

So let's say they did file a police report on the day - April 7 - would I have received a court date/notice by now? It has been just over 2 weeks and I haven't heard anything, so I'm just still freaked out about whether I am going to court or not. Any help please?

I work for Wal-Mart in AP.
If you were cut loose, don't worry about it. You will be sent a packet in the mail explaining that Wal-Mart elects to pursue its rights and remedies available to it by Civil Law.
You will pay Wal-Mart back. Given SOL, if you contest (stupid) the civil restitution, they could screw you.

Thank you nihili! I just paid the civil restitution yesterday so I'm hoping that is it.

Did you get any criminal charge beside the civil restitution? My cousin has faced the same situation (stupid him!!!). I am just wondering if we need to get lawyer for him? according to him no police came since merchant was under $25. but, he signed some paper, but he did not read the paper because he was scared. Please may you let us know what happened in your situation? Thank you!

I work for Wal-Mart Ap also, they won't generally pursue charges for somthing under $25 assuming you're cooperative. You will however get a civil demand letter. Pay it, and everything is done. Choose not to pay, and all bets are off!
