My question involves emancipation laws for the State of: Florida
What are my rights if i am 16 about to be 17 and pregnant?
what can i do, what cant my parents do?
my mom always said if ever i got pregnant that she wouldnt let me leave, she'd make me live here and raise the baby till i was 18. can she do that?
what exactly can she do, im 16 my bf is 18.

Yes she can do that. You are MEDICALLY emancipated...Meaning that you can now make your own decisions regarding your own and your child's medical treatment. In all other aspects of your life MOM and DAD are ruling.

I read somewhere that if your pregnant and in florida georgia or maryland you can marry the man that fathers your child if your 16 with proof from a consultant that you are in fact pregnant without parent consent. is that true.
the only reason i come to this site is to be sure about what i hear.
so please be sure that the info you give me is accurate

741.0405 When marriage license may be issued to persons under 18 years.--
(1) If either of the parties shall be under the age of 18 years but at least 16 years of age, the county court judge or clerk of the circuit court shall issue a license for the marriage of such party only if there is first presented and filed with him or her the written consent of the parents or guardian of such minor to such marriage, acknowledged before some officer authorized by law to take acknowledgments and administer oaths. However, the license shall be issued without parental consent when both parents of such minor are deceased at the time of making application or when such minor has been married previously.
(2) The county court judge of any county in the state may, in the exercise of his or her discretion, issue a license to marry to any male or female under the age of 18 years, upon application of both parties sworn under oath that they are the parents of a child.
(3) When the fact of pregnancy is verified by the written statement of a licensed physician, the county court judge of any county in the state may, in his or her discretion, issue a license to marry:
(a) To any male or female under the age of 18 years upon application of both parties sworn under oath that they are the expectant parents of a child; or
(b) To any female under the age of 18 years and male over the age of 18 years upon the female's application sworn under oath that she is an expectant parent.
(4) No license to marry shall be granted to any person under the age of 16 years, with or without the consent of the parents, except as provided in subsections (2) and (3).

just to be sure of what i read can you tell me if i understand fully
i have to have parents consent, unless parents are deceased...
then if i have parent consent the court will only grant the marriage license if im pregnant?

If your mom consents, you don't have to go in front of a judge.

im 16 hes 18 im pregnant and i live in florida so i dont need moms consent? i dont live with dad so he has no say he ahs no custody of me

That would be the easiest way to get married.
If she doesn't consent, you would have to go in front of a judge that may at his/her discretion allow or deny a marriage license.

743.01 Removal of disabilities of married minors.--The disability of nonage of a minor who is married or has been married or subsequently becomes married, including one whose marriage is dissolved, or who is widowed, or widowered, is removed. The minor may assume the management of his or her estate, contract and be contracted with, sue and be sued, and perform all acts that he or she could do if not a minor.

I don't understand why you don't understand that.
I'll break it down for you.
A minor who is married can assume the management of his or her estate, contract and be contracted with, sue and be sued, and perform all acts that he or she could do if not a minor.
You would be in charge of yourself. However, you still cannot drink, smoke... do things that are illegal for a 16 year old.

Here's another thing you want to consider.
If you are sixteen, then in Florida it is ILLEGAL for your boyfriend to have sex with you, and since Florida has very strict laws about this, when you go before a judge to ask permission to get married without your mother's consent, you may be sending your boyfriend to jail.

One more thing that you may want to consider...
Don't bite the hand you may need to feed you one day. The chances of a 16 year old and an 18 year old getting married and it working long term are slim to none. That mom you're ready to defy may not be all that willing to take you back once you divorce.

Thank you for pointing this out. The OP is definately placing her BF at risk if they try to marry before she is 18.
