MySpace Harassment

My question involves criminal law for the state of: Texas
What can be done about people posting things about you on their myspace page where anyone can read them, such things that are wrong, calling you names, and causing me trouble at home? I'm very ill due to it, and causing me alot of heartache, because its my son, and daughterinlaw. Reporting it to myspace does no good. Please help me.

I would just ignore it. They could be charged with slander, but is it really worth all that effort? Just stay off myspace.

When it's written -- it's called "libel.":D

To the OP - in order to get Myspace to respond, you need to have your own account and contact Customer Service. I have known plenty of Myspace's that have been removed for violating the TOS but you have to be a member to effectively contact their customer service.

And it takes a week on average for them to respond.

Hi there - is the author of the Myspace in close proximity to you? You could file a police report.

They live about 70 miles from me.

We don't know if they are doing anything illegal.

Then it really depends on what is being said - if real names are being used, if threats are being made. You could make a police report to get it on file but unless there is an actual crime taking place, the best you can hope for would be a phone call from an officer telling them to stop.

Our family has had some similar issues with people using Myspace for inappropriate purposes, and our best results have been by:

1) not letting the person behind the comments know that you know about it or that it bothers you - you let them win, and

2) Making an account on Myspace and contacting Customer Service for a Terms of Service Violation, and

3) Filing a complaint with the local police department just in case, though nothing came from it.

Harassment is illegal in every jurisdiction I know of. That doesn't mean they will invest the resources into doing anything about it.

How is it harrassment when all she has to do is ignore it? She is the one going there to read it.

Agreed. Unless they believe the victim is in danger, police rarely enforce harassment laws. I can't blame 'em. I don't want my tax dollars wasted because somebody offended their fried/neighbor/family member!
