If they are in her name, and they are not married, no.
You are only able to go after his assets. Have you filed for contempt of the order?

I have several times we go to court he pays a little bit of money to stay out of jail and then thats it. It gets frustrating cause I have NEVER kept his kids from him I have never degraded him in front of them and most of all I have raised them by myself struggling to get by paycheck to paycheck. It angers me cause when I do call his house to question receipt of my child support I get belittled and cursed at by her.

The simple fact of the matter is this. Someone who is hell bent on not paying support will not pay support. If you keep dragging him in front of a judge and he then pays the purge, then that's what you're going to need to do to get money out of him. Other than that, IMO, it's not worth the stress and aggravation.

1st She answers the phone. 2nd He works on scallop boats and is rarely there. The state of Virginia considers him an independent fisherman so I cant even get them to garnish his wages. He doesnt file taxes so I dont receive his. I have done everything that I am suppose to do legally yet it seems the system protects him and my children go wothout. Its not right and im tired of it.

I'm confused as to what him not being home has to do with you discussing your child support or lack thereof with his girlfriend. She's not responsible for supporting your children, therefore this is not a matter that needs to be discussed with her in any way, shape or form.
You're stressing yourself out.

Due to the fact that hes not there majority of the time she gets his pay and spends it how she feels fit. I speak to her for respect of my children and when they do go see their father I dont need for them to sit with a woman who is going to be mean to them. So if I am to receive any money I have to talk to her and I have to be cordial. I appreciate your advice, however not your judgement. Thank you!
