Access Group And SOL
My question involves collection proceedings in the State of: FL
I've recently received a call and a letter from The Access Group concerning a private student loan. FL's SOL is 5 years on a written contract, which has passed. However, Access turns out to be a non-profit lender. Does this mean that the SOL does not apply as with a govenment loan?

From what I have read...the SOL does apply with all private loans period, regardless of Non-profit.

Thanks for your answer. Now I have another regarding the SOL with the Access Loan. I dug into my boxes of papers (not fun!!) that I have stored and found that the first payment was due on April 5, 2003. From what I've found here and in other research, I think means my account went into at that time. Since FL's SOL on written contracts is 5 years, it seems that the SOL has passed. Now Access is claiming that, no, they consider default to be three months after the first payment was due, which would mean that they have until June 5 of this year. :wallbang: My argument is that state law trumps their "opinion." Where do I stand with this?
