I Find All This SHOCKING
My question involves criminal law for the state of: TX
I am new to this site and I must say it is an amazing place.
I had a question about my own situation and many have helped me to figure out my problem (financial). I think this site is GREAT. The judges and lawyers donate time to help out everyday people.
NOW FOR MY QUESTION.
Is this really everyday people on here? I look on here and see all the people who do their crimes then come on here to look for advice on how to get out of the time they may get based on specific crimes. Is this really the American way????? Instead of trying to get out of a situation, why not do this?
BEFORE you do your crime, say to yourself ---- is the crime worth the time? If your answer is NO (which it should be) then do NOT do the crime in the first place.
I am NOT a lawyer nor do I work for a lawyer. I am a criminal investigator for a governmental agency. I guess I would be out of a job if people took my advice, however, I would love to be forced into a new line of work. I just wish people would think before they act.

I'm not shocked at all. People commit crime because 90% of the time they get away with it. But eventually they get caught. Then they come on here and beg for our help.

If you are asking if we have to occaisionally choke down bile before we answer "how do I get out of being punished for a crime I did and did happily?", then the answer is yes.
Well, probably not for some of the lawyers here. That is not a slam against lawyers.
If you want to be a defense attorney when you grow up, you have a different mind set that doesn't see this sort of thing the same way the rest of the population do. And that difference in viewpoint is why the system works.

Exactly!!! About the only that shocks me anymore is turning off the wrong breaker before doing electrical work around the house..........other than that, and back on topic, if too many people did too much thinking then the world would be a much better place all the way around. But, they don't, and, it ain't!
I refer to the concept as job security.:cool:

The shoplifting ones in particular really piss me off. My husband is a retail store manager and has to deal with thieves every day.
It's a crying shame he's not allowed to take them out back and beat the hell out of them.
I also wouldn't mind a Clue Bat to apply to the people who let us know that yes, they did commit the crime, now what are the odds that they'll get off? (Or the variants, like "What will happen to me?") They don't seem to notice the stunning lack of crystal balls around here.

If you are truly a Criminal Investigator, you must know that criminals are stupid. If they had brains enough to think before committing the crime then they probably wouldn't commit the crime...right??

True, but did you ever notice that there are many more stupid people now than in the past?
It is because we have tried to "idiot proof" the planet... though, granted, they seem to keep creating better idiots.
For instance, do you really need a warning that you shouldn't use a toaster in the bathtub? Or that lawn mover blades are, well, blades?
In the past, idiots would check their gas level with a match and would, therefore, remove their presence from the gene pool.
Now, they become regional political candidates.

How about this one
Lynn Ladder Company was sued (and lost!) for not posting a warning cautioning customers from placing their ladders in dog poop! Some brain trust put his ladder in frozen poop....spring came and the poop got soft and the ladder slipped and the guy broke an arm. Yes! People are indeed idiots!

No charges for man who killed wife in TV mishap

SEDALIA, Mo. -- Prosecutors are not expected to file charges against a Missouri man who fatally shot his wife while he was trying to install a satellite TV system in their home.
Henry County investigators ruled that Patsy Long's March 22 death was accidental. Her husband, Ronald Long, fired his .22 caliber pistol from inside their Deepwater home after he couldn't punch a hole through the exterior wall using other means.
The sheriff's office said the 34-year-old woman was hit in the chest by the second of two shots.
Henry County Prosecuting Attorney Richard Shields said his office does not expect to press charges.

And again, I am sorry to anyone whom I may offend with this.
The judges, lawyers and other senior members who are on here helping people who lets just say "get in over their head" have to realize something.
These people are NOT here just becaused they used bad judgement. They are just SORRY that they have been CAUGHT. If someone does a crime and is not mentally deficient in the eyes of the law, that person deserves what they get.
I have read a good chunk of the forums on this site. It does NOT matter if it is criminal or civil. From what I can tell on the civil forums people just do not want to pay and see if they can get away with it. How is that differient then a criminal act? of hmmmmm, writing a bad check?
Again, I think it is a great service that you people are providing. However, I also find it offensive to some degree. I am sure that the senior members on here do NOT throw their bills in the garbage, do NOT go out doing crimes, etc. Sure, some people do make mistakes, however, I also honestly believe that most know exactly what they are doing. THEY ARE JUST SORRY THAT THEY HAVE BEEN CAUGHT.

In my opinion that is why there are so many are repeat offenders. They try to figure out why they where caught last time so the next time they try to avoid the "mistake", only to make another kind of "mistake" the next time around.
Then again they are SORRY (that they where caught of course) :eek:

BOR would know the answer to this, but I think I've pissed him off with the whole BOR/Carl thing. You know how he's very well researched in supreme court cases? I asked him what he thought of Lawrence v. Texas. I think that was the straw that broke the camels back.

For our legal system to work, every single person accused of a crime is entitled to a vigorous defense.
Law is not completely black and white. In fact, it is far more accurately described as an exercise in grays.
Having said that... the only way to make sure that laws properly govern the people within their jurisdiction is to continually stretch them to fit current issues.
If they don't fit... then new laws are required and old ones can be retired.
Finally, all accused are innocent until proven guilty.

Can I ask you if you have children? My kids do what I call "stupid shit" all the time (not criminal things, stupid things). I can't explain it and they know better but they still do it. It will drive you nuts trying to figure out the "why" part. Some kids are sorry and remorseful when they get caught. Some of them aren't mature enough to understand that things can happen to them. Part of that invincable thing they got going on. But if you can help just one person, then why not try?
I get what your saying...it's just that I see the grey area. Some of us have them clearly defined in our own worlds. I personally (sorry if this offends anyone) hate the "I did it bc I'm an addict" or "I suffer from depression" as if depression causes you to put the necklace in your purse. Some people your just never going to reach. :wallbang:

The old saying "if you dont want to do the time, dont do the crime" must not be taught to children anymore.
I know it is wrong to say, but I do blame the parents. Children should know the differience between right and wrong. In this day and age of SUE everyone, get what you can for free, etc it is no wonder so many people are doing crime as a source of income.
Children should be taught - DO NOT DO ANY CRIME it is NOT worth it. I see people on here all grown up now doing all types of crimes. I know that there are 2 million Americans in prison, however, after what I read on here, I see that going much much much higher.

If you hadn't said that, THIS would make it blisteringly obvious.
You can teach your kids anything you want to teach them, but the simple fact of the matter is that some kids, no matter how well taught, are going to go out and get themselves into trouble. I saw it every day when I worked in the school system, I see it every day now as a parent of teenagers with active social lives.
Lawdy, some of the shit the kids at school get up to.
Those kids grow up and continue doing as they please, no matter what their parents taught.

I think that its pretty sad how our government work and whats more interesting is you posting that comment considering the line of work your in. Not everyone who commits a crime actually wants to do it. Some people are in hard spots and cant get out. They think that stealing would maybe pay some bills or put food in their mouths but later finds out that their children could be without parents but thats after the fact. Maybe you should change your line of work and look into how to better out society......for instance why do people on aid have to attend workfirst and most of them are NOT getting jobs because they dont have the qualifications to do so. Yet If they want to go to school and are over a certain age are told no....or we wont help you? How does that make sense? I pay my taxes and have family that are well off but I also understand the circumstances that some people are dealt and hopefully learn from after their first offense.
I would also intrest you in finding information on why so many young people are having children and on aid? We have to be a certain age to drink, smoke etc but yet anyone can have a child and get stuck in certain circumstances because they ARE young and dont have the support of family and are just plain YOUNG (when you are young you dont fully understand the BIG PICTURE of life yet)
I personally know alot of people myself who are very good parents just tired of struggeling. Not saying that stealing is the answer because its not......but there is alot more that goes on in someones head than obviously you think of.

Well you may be right, NOT everyone wants to commit crime, however, in the division I work in people KNOW what they are doing. It is planned. If it is to put food on the table or whatever is NOT my concern. If someone needs money they can get a job, go on welfare etc. The money most obtain by crime is EASY money so they go for it.
Rather then work for it, they rather do a crime for it. They can obtain more money in a shorter period of time. I am very sorry you feel that way. I enjoy my job and I will never leave it as long as people try the shortcuts of crime.
You sure sound like a defense attorney to me. You have your job because of crime and so do I. I would love to find another line of work IF AND WHEN people would give up criminal acts. Now we both know that will never happen. Someone always will think they are smarter then the law. That is why I find stupid people interesting.

Look, 99% of us have done something illegal at one point in out live. I'm not saying society is full of violent criminals, but we've all committed some misdemeanor. The problem is, most of us never got caught. The people in jail are the ones who weren't so lucky. I'm stating a fact here, not trying to justify criminal behavior!

Well sure, there are alot of petty crimes. That is not what I am talking about. I am talking about a more serious crime (felony).
I have not been on this site for a few days. Do you know why? CRIME......
I have been sooooo busy at work. Just as fast as we can lock them up...... there are new people to take their place. If we lock up a drug dealer there will be TWO new people to take the place of the ones that are behind bars.
Again, the new dealers are SMARTER then the ones we just arrested. They will never be caught or prosecuted, right?????? Maybe it is how some people think. Afterall they did drop out of school at 16, they learned more on the streets then any JUDGE or Lawyer can learn in college. They are so smart that they will make more money in a short time. Do you think they care that poeple will DIE because of the drugs they are selling????
The answer is NO. All they care about is the criminal enterprise they are running and how much money they can make.
Now I am not capable of winning any arguement with a lawyer or judge on this. All I am saying is what is on my mind. :wallbang:

Sure, but I don't remember turning to crime as a viable option.
Are you really advocating mandatory sterilization of human beings until they become a certain age?
The problem with second chance programs is this... most of us, hard as it is to believe, didn't get into any trouble. Most people did not commit any crime worse than drinking on a fake id or speeding.
Why should those of us that DIDN'T turn to crime be viewed the same way as those that took the easy path?
