    First time Petty Larceny---Confused and Looking for Help
    Just yesterday I got caught shoplifting an item under $20 from a department store in the mall. It's my first offense, and the first time I've done anything like this. I'm over 18, and it happened in the state of NY.

    But I'm confused on what happens from here. I told the officer that I had an uncle that is a city cop, though he's my boyfriends uncle. She said I could have him come to the court appearance date and talk to the District Attorney, and with this being my first offense of any kind and pleading that I'm otherwise a good person and have recently had a lot of personal issues to deal with (etc.) he can possibly keep me from having anything go on my record.

    Otherwise I think I remember her saying that I'd have to hire an attorney and probably go to court after the "Court Appearance", but that I could possibly have it removed from my record if I don't commit another crime after 6 months.

    So how much of this is true, and what should I do for the court appearance??? It's 3 weeks from today, and I don't know if I should look for an attorney or just have my boyfriends uncle (city police officer) help me.

    I havent asked his uncle for help yet, for one because I want to figure out the best route to go, and 2 he's out of town for the next couple days.

    Can someone help me with this info, point me in the right direction, or offer any advice? THANKS SO MUCH!

    If you don't want to wait until your boyfriend's uncle is back in town, by all means consult a lawyer. Otherwise, wait a couple of days, talk to your boyfriend's uncle, and decide at that time if you also wish to consult a lawyer.

    What happens from here though. Can I believe what I was told? And what can I expect from a court appearance? Should I definately have someone there for that appearance (whether my bf's uncle or an attorney)?

    Consultations with lawyers are free of charge. I'd start calling ones in your area and ask if they handle retail theft cases. When you get there ask whats the best they can do for you. I paid my lawyer a total of $250. Don't waste time, the sooner you deal with this the sooner you can get supervision! I got supervision, a fine, and it's off my record when the supervision is over in Jan. Worth every penny.
