Bankruptcy Nearly Concluded
My chapter 13 case was closed on 3/6/08. I made my last payment back ion 8/07- I have satisfied my plan base. My trustee still has 4600$+ on hand. On NDC13 I see where it now says that they are awaitng 3rd party action, review in 30 days. What does this mean? Is my case over or can there still be problems with discharging my case. Also, I have a question I have gotten conflicting answers to. My student loans are included in my chapter 13 repayment. I have asked different folks what will happen. Some people say that because my plan was filed before the law changes and they (student loans) are included in my plan under the parties to be paid at 25% that they will be discharged. Other schools of thought conclude that student loans are not dischargeable. Any ideas??
Re: Bankruptcy Nearly Concluded
In fact, I spoke with my attorney over 5 years ago with regards to this matter. If memory serves me correctly, he was going to "slip" the student loans in there. Unfortunately, the secretary is about the only person left at the firm that was there 5 years ago. Anywho, what about the rest of my post. Is it safe to assume that I am done? What could go wrong at this point? What is going to happen to the 4600$+ still "on hand"?? Thanks for your help/answers.
