Given Home By Father, But Now In Family Dispute

Im one out of four children,(i was sole caretaker) of my mom and dad for 3 yrs. my mother passed away in summer of 2007 they retired in N.C..My youngest brother who is also my fathers favorite was given a home in state he lives and works in. my father still resides in home in N.C. and will till his demise.This home was deeded to me
My mothers last wishes wish were for all children to have a home. My brother and I were only 2 who didn't have our own home. Favorite found out net worth of home which was deeded to me, he then wanted it. When I refused to trade homes(i didn't want to move 7 states away) he got mad told other children value. Now everyone has disowened me and now dad wants home back.I have been threaten by dads attorney's by my father, and siblings ect....I know nothing can be done to me.Except this is all to heart breaking(we were all close)
I do not have alot of money, I recenty aquired a life estate quit claim deed for my father.
I have no stipulations in it. I just wanted him to know it will be his home intil his demise.
I was told he would be resposible for taxes, and upkeep.Is this true?
I cant afford taxes ect... I also could not afford to write up any stipulations in life estate for home I was deeded.. I have not yet recorded it, still have warranty deed.
Would like to know if this is enough to protect myself and my father.
could there be consequences or problems for me after his demise, from siblings?
Should I or Can I have another paper written up and noterised??
This has been a total nightmare.
I was going to just give home back, intil I found out he wants fav to be put on deed with him, also he is sole excuter of will. I was excuter.
My brother is mixed up in some really bad stuff Cant tell father anything doesn't beleive anyone. Sunrises and sets on my brother in fathers eye's.
I promised and is written other 2 children get partial sales of home when i sell it. Trying to protect all.

Answer seeking do i have to put into writting anything with life estate deed, and by putting warranty deed into life estate deed by quit claim deed. Will this protect estate.

So basically you were taking care of your father, tricked him into signing his house over to you by misleading him as to its value, and when your family found out everybody was furious with you. And you want to keep the house, but now are thinking of giving your father a life estate, and are promising to give your siblings a share of the value of the house when he dies?

I can't tell you what will fix things with your father or family, or stop legal threats. You need to work that out with them.

No mr. KNOWITALL you know nothing my brother who was deeded other home found out net worth of home deeded to me was worth more than his, He got upsett. Told Lies. I took care of mother and father expecting nothing in return. when i found out I was given home i wrote a paper stateing my other sibling home would be payed off and, and give other sibling whos house is payed off same amount.I did not even know the value of the property intil I received deed in my mail box.Mom wanted all 4 of her children to have there own home, it was her last wishes. DAD did it wrong and brother lied to father to get more.

I came to this site to find what would be best to protect my father as long as he is alive and also property intil sold and i could divide it after his demise.Father wanted deed back to put my little drug addicted brother on deed and made him excuter.(who tricked who here when brother has a home given to him and is living in it)

My morals are in tact. iwould have never used this site if I had the money toseek a attorney which now I know I need to get my father a living trust. so my brother has a $300.000 dollar home on five acers in his home state, and still wants more. siblings are upsett because of his trickery and lies to my father.They know now after they received written sighned paper from the courts right intentons on my part.

So I took the interpretation of events that your father, siblings, and the rest of your family accept as true, and didn't give you the benefit of the doubt... so sorry. :rolleyes:

If you were to omit all of the extraneous detail and ask a question in plain, somewhat coherent English, what would your question be?

I had a difficult time as well following your post.
If you could clear a few things up it might help.
1. Were your parents married at the time of moms death?
2. Did each child in fact get a house?
3. Whos' the trust that you set up for? Dad? brother? (I'm wondering why would you do this after the fact as it goes against your mothers wishes)
4. I don't suggest that you sign ANY deeds, trusts, etc unless you seek legal advice from someone. Your emotional and it's understandable but be rational about it.
5. Are you still in charge of dad's estate?
6. Is there money still left from dad's estate after he dies?
Heck it might just be easier if you repost.

Some things that I can say. The house that was left to you is yours if the deed is in your name, PERIOD. Your family, siblings can say and feel whatever they want but just bc the house you got left is worth more than the one bro was left means nothing.

my father is not well and has demesia.my parents retired N.C. 13 yrs ago. i have flown out because i had owned my own biz. and could help them. i finally moved closer when my mother was diagnosed with cancer.she passed away summer of 2007. my father followed her wishes did a will and deeded my brother house out of state. i found out iwas deeded there home. when my mother passed away my brother who was deeded home was only sibling that came out along with his wife. i took a little break. upon my return my brother went with father to attoneys office.deeds were done i did not know as stated prior that i did in fact receive home father was living in.brother found out the value was greater. now brother has lied and father wants home back to deed to him and has made him excuter of will. i cant help him anymore because i was involved in auto accident.
I was trying to find out best way to protect my father and his estate. siblings were mad intil found out truth. I want protection for my dad upon his demise house will be sold and divided amongst other 2 siblings.thought life estate was best option but in fact it is not.Im just trying to keep out of brothers hands, and let father know he will be taken care of and sales of home will be divided after his demise. I cannot afford my own place and pay taxes on home deeded to me that father still lives in
there will be money after fathers demise
because of homes worth i wanted to share monies after sale with other two siblings,my sisters house is not payed off wanted to pay hers off, and give other sibling same amount.
I dont know how much monies will be left if father has medical bills
all this started because of worth of home i was deeded.
now other siblings understand and our fine with all
other brother im afraid will not take proper care of my father if need be.
i was just trying to find best way to protect all.was told life estate for father would be, then told no because I was not excuter,
im trying not to be emotional but all is still raw and my father only beleives my brother out of all children
he is involved in drugs big time along with his wife.
